You further agree that Japalouppe, to increase the value and benefit of this service to you, may provide your name and contact information to a third party service provider.

1.2 Japalouppe will provide services to for horse riding lessons &/or in-house horse riding camps for your children or for yourself. The services can include hourly horse riding lessons / pony rides / lodging in dormitories / consumption of food / trekking / interacting with animals. Japalouppe makes no claims that the data is accurate or applicability of the information to any specific situation.

1.3 Japalouppe may also SMS to the users, send an email to the user letting them know about the service.

1.4 The Site may provide certain Features (“Site” and “Features” as defined under Section 2) that enable push notifications sending/receiving invites/solicitation messages and or emails/reminders to your contacts whose details, as required under the specific Features, are submitted and specifically permitted by you to be so used. Once such a Feature is selected and consented by you.

2. Content & Features – Definition

2.1 “Contents” or “Content” shall mean any and all information, data, text, software, music, sound, photographs, graphics, video, messages, materials, news, notices, articles, contracts, forms, documents or other materials and information which may be viewed or downloaded on or through this Site/Mobile Application. Contents shall also include any e-mail, messages, e-cards or any other information furnished by a user to be displayed on the Site by Japalouppe.

Japalouppe strongly advises you not to post false purchases request, as it will put you at substantial personal legal risk. It is a crime to use a false name, other false personal information to buy. Willfully entering erroneous or fictitious purchase request may result in prosecution by Japalouppe. Please be aware that even if you do not give Japalouppe your real name, your Web browser transmits a unique address to us, which can be used by law enforcement officials to identify you. As a user you certify that all information provided by you against is true. Your online registration will be stored for a period of 6 months after which it will be automatically deleted incase of inactivity. You can register again in case you want to enroll yourself or your child.

10. Login Options

The Japalouppe Members login (if any) is for the reference of only registered Japalouppe’s Member. Japalouppe reserves the right to discontinue the member Login on account of violation of this Agreement or any “Code of Conduct” set by Japalouppe. Japalouppe reserves the right to take all measures necessary to prevent access to any Content or portion of the Site or terminate access to the Site if the terms of use are not complied with or are contravened or there is any violation of copyright, trademark or other proprietary right.

11. Disclaimer Website:

Japalouppe makes no warranties or representations as to the contents of this site and Japalouppe assumes no liability or responsibility for any errors or omissions in the content on the Site. 12. Pictures/Videos Disclaimer

Japalouppe Equestrian Centre Pvt Ltd (JEC) reserves the right to use any photograph/video taken during your visit/event /camp held by JEC, without the expressed written permission of those included in the pictures/videos or of their legal guardians in case of minors. JEC may use the photograph/video in publications or other media material produced, used or contracted by JEC including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, social media, etc.

A person attending a JEC event who does not wish to have their image recorded for distribution should make their wishes known to the photographer, and/or the event organizers, and/or contact JEC at Old Mumbai Pune Hwy., Talegaon Dabhade, Pune 410506 Maharashtra, India, in writing of his/her intentions and include a photograph. for identification purposes which JEC will hold in confidence.

By participating in a JEC event/camp or by failing to notify JEC, in writing, your desire to not have your photograph used by JEC, you are agreeing to release, defend, hold harmless and indemnify JEC from any and all claims involving the use of your picture or likeness.

Any person or organization not affiliated with JEC may not use, copy, alter or modify JEC photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from JEC.

13. Limitation of Liability

Neither Japalouppe nor its affiliates, employees, agents or consultants shall in any event be liable for any indirect, incidental or consequential damages such as, but not limited to, injury, loss of goodwill, resulting from participation in riding or riding camps. Such limitation of liability shall apply whether the damages arise from use or misuse of or reliance on Japalouppe information, from inability to use Japalouppe information, or from the interruption, suspension, or termination of access to the content or site or by any kind of injury cased during horse riding or in-house camps. Such limitation shall further apply with respect to the performance or non-performance of Japalouppe or any information that appears on, or is linked or related in any way to, the services provided there-under.

14. Acknowledgment

The disclaimer and limited liability of Japalouppe as set out in this Agreement are fundamental elements on the basis of the bargain for the Content and access to the Site and it’s services. You agree that Japalouppe would not otherwise be able to offer the services on its present basis without such limitations. This clause shall survive any termination of this Agreement.

15. Special Admonitions for International Use

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

16. Severability

Any provision of this Agreement which is invalid, prohibited or unenforceable in any jurisdiction shall:

• be ineffective in that jurisdiction to the extent of the invalidity, prohibition or unenforceability
• not affect the validity of that provision in any other jurisdiction.

17. Governing Law and Arbitration

All legal proceedings shall be subject to the jurisdiction of the courts in Pune – INDI, and shall be governed by and construed in accordance with the laws of India and you agree to resolve the disputes under the Arbitration and Conciliation Act 1996. The venue for such arbitration shall be at Pune, India.

18. Relationship

This Agreement or your use of this Site does not constitute any joint venture, partnership, employment or agency relationship between you and Japalouppe.

19. Customer Registration

In preview of the Telecom Regulatory Authority of India (TRAI) guidelines, You hereby authorize Japalouppe Equestrian Centre Pvt. Ltd.. www.japalouppe.com and its affiliates / partner, or any other related player in the field of horse riding or otherwise who are accessing the data by virtue of their association with Japalouppe to communicate with me/us through telephone/mobile, Email, SMS or other modes of communication even if my/our number/numbers(s) is/are registered in the National Do Not Call Registry (NDNC) or www.nccptrai.gov.in

Indemnity BOND

1. Indemnity and Release from Liability

The Client either in his or her personal capacity as a rider/visitor or as the legal guardian of rider/visitor, agrees and acknowledges to indemnify and hold Japalouppe Equestrian Center Pvt. Ltd. (hereinafter referred to as “JEC” which term includes affiliates, officers, employees, directors and authorized representatives) harmless from any claim or action, including legal fees arising out of the same related to or arising out of the services that JEC provides, Client’s use of the services or JEC premises, use of the site, any connection to the site, any violation of terms and conditions of this site and agreements, or Client’s or Client’s ward’s violation of any other rights or terms and conditions of other users’ of this site and the JEC services and premises.

2. Indemnity- Horse Riding and Related Farm Activities

The Client agrees and acknowledges that activities like Horse Riding, Petting, Handling, Feeding the animals, Free at the property, etc. and being in proximity to all the farm animals is an activity with inherent dangers and involves risks that may cause serious or grievous injury due to the nature and behavior of animals regardless of their training, previous behavior or temperament. Client therefore knowingly and voluntarily assumes these risks upon undertaking this activity or upon entering the premises and agrees to indemnify, release and discharge JEC from any liability for any injury or damage caused or any medical expenses related thereto. Client agrees and acknowledges that JEC provides an environment where the farm animals and riders interact freely and therefore in full knowledge of the same consents to attending or allowing his or her ward to attend the camps/training modules or enter the premises.

3. Safety Codes and Adherence

JEC undertakes to adhere to the highest safety standards within the country and for this reason provides safety helmets and adheres to a strict dress code for riding regarding footwear etc., and the Client agrees and acknowledges that if the Client chooses to refrain or ignore the same, the Client does so at his or her own risk and releases JEC from any liability for the same.

4. Medical

It is the Client’s sole responsibility to inform JEC of any ailments, allergies medications etc. that the Client themselves or his/her ward suffer from or require. JEC is not responsible for the Client’s failure to inform JEC of the same. JEC reserves the right to refuse admission in JEC’s sole discretion if JEC deems that the rider’s health will not allow for the rider to undertake horse-riding or farm activities safely.

5. Admission into and removal from premises during training modules/camps

1. JEC reserves the right to accept or deny admission or access to the premises at its sole discretion. JEC reserves the right to send a rider home or to evict them from the premises if it is deemed that such rider has a detrimental or negative influence and must be removed for the preservation of the well-being of the other riders and participants.

2. Kindly note that in the event the you leave early or do a no-show, irrespective of the reason, no refund will be offered.

      6.Personal Belongings

Clients and/or their wards are solely responsible for the safety of their personal belongings, money and valuables and JEC takes no responsibility for the same. Minor children are discouraged from carrying money or valuables and to do so, is entirely at the Client’s risk and responsibility.
